There was no difficulty in these negotiations as to the full and entire recognition of the independence of the States. The difficult points were but two¡ªone regarding the fishery, and the other regarding the interests of the Royalists or Tories. The British Commissioners stood out strongly for the free permission of all who had been engaged in the war on the English side to return to their homes, and for the restitution of all property confiscated in consequence of such partisanship. The American Commissioners endeavoured to meet this demand by saying the recommendations of Congress would have all the effect that the English proposed. This the Commissioners regarded as so many words, and they insisted so determinedly on this head, that it appeared likely the negotiation would be broken off altogether. At last Franklin said they would consent to allow for all losses suffered by the Royalists, on condition that a debtor and a creditor account was opened, and recompense made for the damages done by the Royalists on the other side; commissioners to be appointed for the purpose of settling all those claims. The English envoys saw at once that this was a deception, that there would be no meeting, or no use in meeting, and they therefore abandoned the point; and the question of the fishing being in part conceded, the provisional articles were signed on the 30th of November, by the four American Commissioners on the one side, and by Mr. Oswald on the other. [502]Although the division took no one by surprise, as the rejection of the Bill by the Lords was expected, yet the shock to society was very violent. The Funds suddenly fell, and there was that feeling of vague anxiety in the public mind which often portends some great calamity. At Derby they broke open the gaol and demolished the property of the anti-Reformers of the place. At Nottingham there was serious rioting, which ended in the utter destruction by fire of the ancient castle, once the property of the Duke of Newcastle, who had given violent offence by his rash declaration with regard to his voters at Newark, "that he had a right to do what he pleased with his own." The popular fury, however, soon subsided, and the public mind regained tranquillity, in the full assurance that the carrying of the Bill was only a question of time, and that the popular cause must ultimately triumph. What[340] most materially contributed to the restoration of public confidence was the fact that the king, alarmed at the prospect of a revolution, implored the Ministers to retain their places, and to shape their Bill so as to disarm their opponents; and on the following Monday, in the House of Commons, Lord Ebrington moved a vote of confidence in the Government, to the effect that, while the House lamented the present state of a measure in favour of which the opinion of the country had been so unequivocally expressed, and which had been matured after the most anxious and laborious discussions, they felt imperatively called upon to reassert their firm adherence to its principles and leading provisions, and their unabated confidence in the integrity, perseverance, and ability of the Ministers, who, in introducing it and conducting it so well, had consulted the best interests of the country. This motion was carried by the large majority of 131; the numbers being 329 to 198. Thus supported by the Commons, the Ministers retained their places; and the king, on the 20th of October, prorogued Parliament in person, in a Speech which the Lords might take as the king's answer to their vote, telling them in effect that by their obstinate bigotry they were setting themselves in antagonism to the two other estates of the realm, and that in their conduct and position lay the real danger to the Constitution. The Assembly in Jamaica had proved very refractory, and, in order to avoid the evil consequences of its perversity, Mr. Labouchere, on the 9th of April, brought forward a measure which was a virtual suspension of the constitution of the island for five years, vesting the government in the Governor and Council, with three commissioners sent from England to assist in ameliorating the condition of the negroes, improving prison discipline, and establishing a system of poor laws. This measure was denounced by the whole strength of the Opposition. The question may be thus briefly stated. Before the Act of Emancipation in 1833, all punishments were inflicted on slaves by the domestics of the master, who was unwilling to lose the benefit of their services by sending them to prison. But when emancipation took place, that domestic power was terminated, and new prison regulations became necessary. The Colonial Legislature, however, persistently refused to adopt any, and continued a course of systematic resistance to the will of the supreme Government, whose earnest and repeated recommendations had been utterly disregarded. Under the apprenticeship system negroes were treated worse than they were under the old condition of slavery, because the planters knew that the time of enfranchisement was at hand. But though, when the hour of liberty, August 1st, 1840, was seen to be very near, the Jamaica Assembly voluntarily brought the apprenticeship system to a termination, they accompanied the measure with an angry protest against any interference by the British Parliament. It was contended, on the part of the Government, that if such a state of things were permitted to exist, the authority of Great Britain over its colonies would speedily be lost, and every little island that owed its political existence to the protection afforded by the Imperial Government, would, without scruple, set its power at defiance. Such being the state of the case, it might be supposed that no serious objection would be raised to the course adopted, in the interests of humanity and good government. But the Conservatives seized the opportunity for another party contest, and became quite vehement in their defence of the constitutional rights of the Jamaica planters. The debate was protracted for several nights, and counsel against the Bill were heard at great length. Eventually the division took place at five in the morning on the 6th of May, when the numbers were 294 to 289, giving the Government a majority of only five, which was regarded as tantamount to a defeat. On the 7th of May, therefore, Lord John Russell announced that Ministers had tendered their resignation, which was accepted by the Queen. He assigned as the reason for this step that the vote which had passed must weaken the authority of the Crown in the colonies, by giving support to the contumacy of Jamaica, and encouraging other colonies to follow its bad example. This obvious consideration rendered more painfully apparent the weakness of the Government, arising from division among its supporters; for if anything could have induced the different sections of the Liberal party to suppress their differences, it would have been the necessity of interposing, in the manner proposed by the Government, to shield the unhappy negroes from the oppression of their exasperated taskmasters. Indeed, in spite of various attempts to patch up the Cabinet, its members were at hopeless cross-purposes. ONE:"The Clare election supplied the manifest proof of an abnormal and unhealthy condition of the public mind in Ireland¡ªthe manifest proof that the sense of a common grievance and the sympathies of a common interest were beginning to loosen the ties which connect different classes of men in friendly relations to each other, to weaken the force of local and personal attachments, and to unite the scattered elements of society into a homogeneous and disciplined mass, yielding willing obedience to the assumed authority of superior intelligence hostile to the law and to the Government which administered it. There is a wide distinction (though it is not willingly recognised by a heated party) between the hasty concession to unprincipled agitation and provident precaution against the explosion of public feeling gradually acquiring the strength which makes it irresistible. 'Concede nothing to agitation,' is the ready cry of those who are not responsible¡ªthe vigour of whose decisions is often proportionate to their own personal immunity from danger, and imperfect knowledge of the true state of affairs. A prudent Minister, before he determines against all concession¡ªagainst any yielding or compromise of former opinions¡ªmust well consider what it is that he has to resist, and what are his powers of resistance. His task would be an easy one if it were sufficient to resolve that he would yield nothing to violence or to the menace of physical force. In this case of the Clare election, and of its natural consequences, what was the evil to be apprehended? Not force, not violence, not any act of which law could take cognisance. The real danger was in the peaceable and legitimate exercise of a franchise according to the will and conscience of the holder. In such an exercise of that franchise, not merely permitted, but encouraged and approved by constitutional law, was involved a revolution of the electoral system in Ireland¡ªthe transfer of political power, so far as it was connected with representation, from one party to another. The actual transfer was the least of the evil; the process by which it was to be effected¡ªthe repetition in each county of the scenes of the Clare election¡ªthe fifty-pound free-holders, the gentry to a man polling one way, their alienated tenantry another¡ªall the great interests of the county broken down¡ª'the universal desertion' (I am quoting the expressions of Mr. Fitzgerald)¡ªthe agitator and the priest laughing to scorn the baffled landlord¡ªthe local heaving and throes of society on every casual vacancy in a county¡ªthe universal convulsion at a general election¡ªthis was the danger to be apprehended; those were the evils to be resisted. What was the power of resistance? 'Alter the law, and remodel the franchise,' was the ready, the improvident response. FORE:The new British Parliament met on November 26, and Ministers were seen to have a powerful majority. The king announced, in his speech from the throne, that hostilities had broken out in India with Tippoo, and that a peace had been effected between Russia and Sweden, and he mentioned the endeavours that were in progress for restoring amity between the Emperor of Austria and his subjects in the Netherlands. In the debate on the Address in the Commons, Fox appeared inclined still to laud France, and to condemn our interference in the Netherlands. His eyes were not yet opened to the real danger from France, whose example was indeed exciting popular disturbances in the Netherlands and in Poland. Already the doctrines of Liberty and Equality had reached the ears of the negroes in St. Domingo, who had risen to claim the rights of man so amiably proclaimed by France, and the troops of France were on their way thither to endeavour to put them down, in direct contradiction of their own boasted political philosophy. In the Lords, Earl Grey¡ªthe father of the Whig statesman¡ªon the 13th of December, called for the production of papers relating to Nootka Sound. The motion was negatived by two hundred and fifty-eight against one hundred and thirty-four votes. But the Marquis of Lansdowne contended that Spain had a right to the whole of the North American coast on which Nootka Sound is situated, and had had it since the reign of Queen Elizabeth. THREE:Towards the end of William IV.'s reign the style of ladies' dress suddenly changed. The unshapely short-waisted robe was succeeded by one of ampler dimensions, longer and fuller, with a moderate amount of crinoline¡ªenough to give dignity and grace to the figure, but not expanding to the same absurd extent as afterwards¡ªand long pointed stomachers. The bonnets were considerably reduced in size. The ball dresses at the beginning of the Victorian reign became more like those of a later day, except that they were then made of heavy, rich materials¡ªsilk, satin, brocade, etc. The style of the sleeve varied, but one of the fashions at this time was a puffing at the shoulder, and sloping gradually down, commonly called the "leg-of-mutton sleeve." THREE:The first debate arose on the subject of drunkenness and gin. Drunkenness had of late years appeared to grow rapidly, and to assume more horrible features from the increasing use of gin. Sir Joseph Jekyll proposed in committee that a heavy tax should be laid on this pernicious liquor, which should put it out of the reach of the working classes¡ªnamely, a duty of twenty shillings per gallon on all sold retail, and fifty pounds yearly for the licence to every retailer. This benevolent man had not arrived at the truth, that to tax a crime is only to stop up one vent of it, and to occasion its bursting out in half a dozen other places. Sir Robert Walpole saw this clearly, and though he would not oppose the Bill for this purpose, he predicted that Parliament would soon be called upon to modify its provisions. The small duties heretofore levied on this article had brought in about seventy thousand pounds annually, and, as the Excise had been made over to the Crown, this sum went to the Civil List. Walpole demanded, therefore, that whatever deficiency of this sum should be produced by the new regulations should be made up to the Civil List. The whole measure excited great clamour out of doors. It was regarded as an invidious attempt to abridge the comforts of the people, whilst those of the wealthy remained untouched. The clause proposed by Walpole to protect the revenue was assailed with much fury both in and out of the House. It was said that the Minister was quite indifferent to the morals of the people on the one hand, or to their enjoyment on the other, so that the revenue did not suffer.Sir Mark Isambard Brunel, a hero of mechanical science, made a great step in advance by the invention of self-acting machinery to supersede the work of artisans, by which a new epoch was created in art. The greatest effort of Brunel was the Thames Tunnel, a structure of perfect firmness and solidity laid on a quicksand, and forced through a quaking mass of mud, which will endure like the cloac? of regal Rome, when the palace and the cathedral have crumbled to dust. He was enabled to accomplish this prodigious work by means of "the shield"¡ªa movable vertical frame of cast iron, provided with thirty-six cells, in each of which a man was placed with a pick to excavate the area, this frame or shield being moved bodily forward by powerful screws, while the bricklayers brought up the arched masonry behind, which was then beyond the power of injury. The works, however, were several times "drowned" during their progress by the irruptions of the Thames, but every fresh difficulty was met successfully by the heroic engineer. The tunnel was commenced on the 2nd of March, 1825, and finished on the 25th of March, 1843. Brunel survived the completion of this, his greatest work, above six years, dying on the 12th of December, 1849.
THREE:The slowness with which the Government became aware of these proceedings is something astonishing in these days of telegraphs and railroads. Though Charles sailed on the 2nd of July, it was not till the 30th of the same month that Lord Tweeddale, the Scottish Secretary of State in London, was informed even that he had left Nantes. Sir John Cope was the commander of the forces in Scotland, and he immediately gave orders for drawing[94] together such troops as he had to Stirling. These were extraordinarily few. There were two regiments of dragoons, Gardiner's and Hamilton's, but both recent in the service; and the whole force at his disposal, exclusive of garrisons, did not amount to three thousand men. Cope was eager enough to march into the Highlands, even with such forces as he had, and crush the insurrection at once. He proposed this apparently active and judicious scheme to the Lords Justices in England, George II. himself being at Hanover, and they warmly approved of it, and issued their positive orders for its execution. It was, in truth, however, the most fatal scheme which could be conceived. The spirit of rebellion was fermenting in every glen and on every hill, and to march regular troops into these rugged fastnesses was only to have them shot down by invisible marksmen on all hands, and reduced to the extremity of the two companies already captured. The plan was to have secured all the passes into the Lowlands, to have drawn his forces to the foot of the mountains wherever a descent could be made, and blockade the rebels in their own hills till they should be reduced by gradual approaches and overwhelming numbers. Famine, indeed, would soon have tamed any large body of men in those sterile regions.
THREE:But the alterations were fatal to the measure in Ireland. Instead now of being the resolutions passed in the Irish Parliament, they embraced restrictive ones originating in the British Parliament¡ªa point on which the Irish were most jealous, and determined not to give way. No sooner did Mr. Orde, the original introducer of the resolutions to the Irish Parliament, on the 2nd of August, announce his intention to introduce them as they now stood, than Flood, Grattan, and Dennis Browne declared the thing impossible; that Ireland never would surrender her birthright of legislating for herself. Mr. Orde, however, persisted in demanding leave to introduce a Bill founded on these resolutions, and this he did on the 12th of August. Flood attacked the proposal with the utmost vehemence. Grattan, Curran, and others declared that the Irish Parliament could hear no resolutions but those which they themselves had sanctioned. Accordingly, though Mr. Orde carried his permission to introduce his Bill, it was only by a majority of nineteen, and under such opposition that, on the 15th, he moved to have it printed for the information of the country, but announced that he should proceed no further in it at present. This was considered as a total abandonment of the measure, and there was a general rejoicing as for a national deliverance, and Dublin was illuminated. But in the country the spirit of agitation on the subject remained: the non-importation Associations were renewed, in imitation of the proceedings in Boston, and the most dreadful menaces were uttered against all who should dare to import manufactured goods from England. The consequences were the stoppage of trade¡ªespecially in the seaports¡ªthe increase of distress and of riots, and the soldiers were obliged to be kept under arms in Dublin and other towns to prevent outbreaks.But, in spite of the importance of these measures, there was one question which engrossed the attention of both parliament and the public far more than any other. This was the demand by Burke for the impeachment of Warren Hastings, late Governor-General of Bengal, for high crimes and misdemeanours there alleged to have been by him committed. It therefore becomes necessary at this point to resume our narrative of Indian affairs from the year 1760, which our connected view of the events of the American war necessarily suspended.

When his intention was announced, he received, through Sir Robert Peel and Lord John Russell, the highest testimony of the esteem in which he was held by the two great parties, not only for his conduct in the Chair, but also for his strenuous exertions to improve the mode of conducting the private business of the House. Mr. Williams Wynn, a member of great experience and reputation in the House, proposed Mr. Goulburn, member for the University of Cambridge. The motion was seconded by Mr. Wilson Patten. It was a party contest, and tested the strength of the Ministry and the Opposition. The House divided on the motion that Mr. Shaw Lefevre do take the Chair, which was carried by a majority of eighteen, the numbers being 317 and 299.

FORE:Wellington did not feel himself secure till he had crossed the Tormes. On his march General Hill came up, and once more taking up his old position on the heights of San Christoval, in front of Salamanca, which he did on the 9th of November, he declared, in his dispatch to the Secretary at War, that he thought he had escaped from the worst military situation that he ever was in, for he could not count at all on the Spanish portion of his army. On the 10th Souham and Soult united their forces, now amounting to seventy-five thousand foot and twelve thousand cavalry; Wellington's army mustering only forty-five thousand foot and five thousand cavalry. He now expected an immediate attack, and posted his army on the heights of the two Arapiles for the purpose; but the French generals did not think well to fight him, and he continued his retreat through Salamanca, and on to Ciudad Rodrigo, where he established his headquarters, distributing part of his army in their old cantonments between the Agueda and the Coa. This was accomplished before the end of November; and General Hill proceeded into Spanish Estremadura, and entered into cantonments near Coria. The French took up their quarters at some distance in Old Castile.

FORE:In Canada the management of the war was more successful. To maintain the war in that quarter, Congress had ordered nine regiments to be raised. One of these was to be raised in Canada itself, and for this purpose a commission was given to Moses Hazen, who had formerly been a captain of rangers, under Wolfe. He was not, however, very successful. The Canadians were not to any extent disaffected to the British Government, and by no means well affected to the New Englanders, who were bitterly bigoted against Catholics, which the Canadians chiefly were. When Hazen and Arnold saw that the Canadians would neither enlist nor bring provisions to their camps, without cash payment, they commenced plundering for all that they wanted, and thus confirmed that people in their hatred of the Americans. They, moreover, insulted the Canadians by ridiculing their rites of worship.

[See larger version]Before the proclamation of the new king the Council had met, and, according to the Regency Act, and an instrument signed by the king and produced by Herr Kreyenberg, the Hanoverian resident, nominated the persons who were to act till the king's arrival. They consisted of the seven great officers of State and a number of the peers. The whole was found to include eighteen of the principal noblemen, nearly all of the Whig party, as the Dukes of Shrewsbury, Somerset, and Argyll; the Lords Cowper, Halifax,[25] and Townshend. It was noticed, however, that neither Marlborough, Sunderland, nor Somers was of the number; nor ought this to have excited any surprise, when it was recollected that the list was drawn out in 1705, though only signed just before the queen's death. These noblemen belonged to that junto under whose thraldom Anne had so long groaned. The omission, however, greatly incensed Marlborough and Sunderland.But the Queen's Bench was by no means disposed to surrender its own privileges, even to the House of Commons. On the 24th of January Sir William Gossett, Serjeant-at-Arms, appeared at the bar of the House, and said that he had last[470] evening been served with a writ of Habeas Corpus, commanding him to bring up the bodies of the sheriffs, William Evans, Esq., and John Wheelton, Esq., then in his custody. The Attorney-General rose, and said he had no hesitation in advising the House to direct the Serjeant-at-Arms to return answer to the Court of Queen's Bench that he held these two individuals in custody by the warrant of the Speaker. He then moved a resolution to that effect, which was adopted, and the Court of Queen's Bench acquiesced.
