THREE:The chiefs of the Tory party were at this time sanguine in their expectation of being speedily called to office. Their hopes were founded mainly upon the dissensions that were known to exist in the Cabinet. These dissensions were first revealed by O'Connell's motion for a committee to inquire into the conduct of Baron Smith, when presiding as a judge in criminal cases, and especially with reference to a charge addressed by him to the grand jury of Dublin, in which he said: "For the last two years I have seldom lost an opportunity for making some monitory observations from the Bench. When the critical and lawless situation of the country did not seem to be generally and fully understood, I sounded the tocsin and pointed out the ambuscade. Subsequent events deplorably proved that I had given no false alarm. The audacity of factious leaders increased from the seeming impunity which was allowed them; the progress of that sedition which they encouraged augmented in the same proportion, till on this state of things came, at length, the Coercion Bill at once to arrest the mischief, and consummate the proof of its existence and extent." As there was no doubt that these shafts were aimed at O'Connell, this last charge afforded him a fair opportunity of putting a stop to the abuse by bringing the conduct of the talented but eccentric judge before Parliament; for, as there was no political case in the calendar, there was no excuse for the attack. Mr. Littleton declared it impossible to refuse his consent to the motion. Mr. Stanley, Lord Althorp, and Lord John Russell expressed a similar view. Sir James Graham briefly but warmly dissented from his colleagues. He had come down to the House with the understanding that they meant to oppose the motion. He for one still retained his opinion, and had seen no reason to change it. As one who valued the independence of the judges and his own character, he must declare that if the motion were carried, and if, as its result, an Address was presented to the Crown for the removal of Baron Smith, it would be a highly inexpedientnay, more, a most unjust proceeding. The present would be the most painful vote he had ever given, since he felt it incumbent upon him to sever himself from those friends with whom during a public life of some duration he had had the honour of acting; but feeling as he did the proposition to be one dangerous in itself, he conceived he would be betraying the trust committed to him if he did not declare against it. Baron Smith was ably defended by Mr. Shaw, by Sir J. Scarlett, and Sir Robert Peel. On a division, the motion for a committee of inquiry was carried by 167 to 74, Sir James Graham and Mr. Spring-Rice voting in the minority. Next morning Sir James tendered his resignation as First Lord of the Admiralty, which was declined, and in the following week the vote was rescinded by a majority of six.

THREE:By the 28th of September Mar had mustered at Perth about five thousand men. He was cheered by the arrival of one or two ships from France with stores, arms, and ammunition. He had also managed to surprise a Government ship driven to take shelter at Burntisland, on its way to carry arms to the Earl of Sutherland, who was raising his clan for King George in the north. The arms were seized by Mar's party, and carried off to the army. Argyll, commander of the king's forces, arrived about the same time in Scotland, and marched to Stirling, where he encamped with only about one thousand foot and five hundred cavalry. This was the time for Mar to advance and surround him, or drive him before him; but Mar was a most incompetent general, and remained inactive at Perth, awaiting the movement of the Jacobites in England. Thanks, however, to the energy of the Government, that movement never took place.The Wesleyan Methodists were next in number to the members of the Established Church. The progress of this society was very rapid after 1820. In that year the number of its ministers was 718, and of its members or communicants in Great Britain, 191,000. In 1830 the numbers were respectively 824 and 248,000; and so largely did they increase in the next ten years, that in 1840 the ministers were 1,167, and the members 323,000. The 1851 census returns showed 6,579 chapels belonging to this connexion in England and Wales, containing accommodation for 1,447,580 persons. The Society of Friends, on the other hand, was declining. The Roman Catholics made considerable progress in England during the last two reigns. In 1829 they had 394 chapels, which[428] in 1840 had increased to 463, and in 1852 they reached 600. They had at the same time 11 colleges, 88 religious houses, and 875 priests. Their chapels at the time of the census furnished accommodation for 186,000, and the number of attendants on the morning of census Sunday of 1851 was 252,983.

To this communication Sir Robert Peel returned the following reply:"Sir Robert Peel presents his humble duty to your Majesty, and has had the honour of receiving your Majesty's note this morning. In the interview with which you honoured Sir Robert Peel yesterday morning, after he had submitted to your Majesty the names of those he proposed to recommend to your Majesty for the principal executive appointments, he mentioned to your Majesty his earnest wish to be enabled, by your Majesty's sanction, so to constitute your Majesty's Household that your Majesty's confidential servants might have the advantage of a public demonstration of your Majesty's full support and confidence, and at the same time, so far as possible, consistent with such demonstration, each individual appointment in the Household should be entirely acceptable to your Majesty's personal feelings. On your Majesty's expressing a desire that the Earl of Liverpool should hold an office in the Household, Sir Robert Peel immediately requested your Majesty's permission at once to confer on Lord Liverpool the office of Lord Steward, or any other office which he might prefer. Sir Robert Peel then observed that he should have every wish to apply a similar principle to the chief appointments which are filled by the Ladies of your Majesty's Household; upon which your Majesty was pleased to remark, that you must retain the whole of these appointments, and that it was your Majesty's pleasure that the whole should continue as at present, without any change. The Duke of Wellington, in the interview to which your Majesty subsequently admitted him, understood also that this was your Majesty's determination, and concurred with Sir Robert Peel in opinion that, considering the great difficulties of the present crisis, and the expediency of making every effort, in the first instance, to conduct the public business of the country with the aid of the present Parliament, it was essential to the success of the mission with which your Majesty had honoured Sir Robert Peel that he should have such public proof of your Majesty's entire support and confidence, as would be afforded by the permission to make some changes in your Majesty's Household, which your Majesty resolved on maintaining entirely without change. Having had the opportunity, through your Majesty's gracious consideration, of reflecting upon this point, he humbly submits to your Majesty that he is reluctantly compelled, by a sense of public duty, and of the interests of your Majesty's service, to adhere to the opinion which he ventured to express to your Majesty." Subsequent explanations proved that the gaucherie of Sir Robert Peel was chiefly responsible for the crisis. He was right in principle, but he was wrong in the abrupt manner in which he appeared to force the change of the Ladies upon the Queen. The Duke, with his usual shrewdness, had foreseen that the accession of a female Sovereign would place the Conservatives at a disadvantage, because, said he, "Peel has no manners, and I have no small talk."Saxe followed up his advantage by despatching L?wendahl against Bergen-op-Zoom, the key of Holland, and the masterpiece of the celebrated engineer, Cohorn. This was not only amazingly strong in its fortifications, but had a powerful garrison, and was covered by an entrenched camp of twelve thousand men. The trenches were opened in the middle of July, and might have defied all the efforts of the French, had not Baron Cronstrom, the commander, a man of eighty, suffered them to take it by surprise on the 15th of September. The French had led a vast number of men before this place, and its surrender ended the campaign.The spirit of the country appeared to be running in a strong current for the return of Lord Chatham to the helm, as the only man who could save the sinking state, and bring the American difficulty to a happy issue. But the great obstacle to this was the still continued assertion of Lord Chathamthat the full independence of America could not be for a moment listened to, whilst to almost every other man of the Opposition that independence was already an accomplished fact. Lord Rockingham, who was looked up to as a necessary part of any Cabinet at the head of which Chatham should be placed, had, in the previous Session, asserted his opinion that the time had now passed for hoping to preserve the dependence of these colonies; and, now he saw France coming into the field against us, he was the more confirmed in this view. This was a fatal circumstance in the way of the establishment of a strong co-operative Cabinet, formed out of the present Opposition. But a still greater obstacle was the iron determination of the king. In vain did Lord North express his desire to resign and declare the necessity of conciliatory measures. George reproached him with intending to desert him. On further pressure he gave him leave to apply to Chatham and the Whigs, but only on the absurd condition that[250] they should join the present Ministry, serve under Lord North, and carry on the policy of the existing Government. As usual, Lord North gave way, and consented to stay in office, and to bring in a plan of conciliation opposed to his former declarations.[See larger version]
