TWO:The ordinance was disallowed at home. Lord Brougham, who had never forgiven his former colleagues the constitution of the Cabinet without his forming a part of it, signalised himself by the extreme bitterness with which he headed the onslaught. Lords Melbourne and Glenelg softened the matter to him as well as they could; the former communicated the intelligence with the greatest regret and the deepest apprehension as to its consequences. Lord Durham betrayed his mortification unwisely in a proclamation which he immediately issued. As the banishment was an exception to the general amnesty he had published, he informed the prisoners at Bermuda that her Majesty being advised to refuse her assent to the exceptions, the amnesty existed without qualification, and added"No impediment, therefore, exists to the return of the persons who have made the most distinctive admission of guilt, or have been excluded by me from the province on account of the danger to which it would be exposed by their presence."

A settlement might also be obtained by being hired for a year when unmarried or childless, and remaining the whole of that time in the service of one master; or being bound an apprentice to a person who had obtained a settlement. The effect of this system was actually to depopulate many parishes. The author of a valuable pamphlet on the subject, Mr. Alcock, stated that gentlemen were led by this system to adopt all sorts of expedients to hinder the poor from marrying, to discharge servants in their last quarter, to evict small tenants, and pull down cottages; so that several parishes were in a manner depopulated, while[363] England complained of want of useful hands for agriculture, for manufactures, and for the land and sea services.

THREE:During this period Richard Bentley, Master of Trinity College, Cambridge, and archdeacon of Ely, figures prominently as one of the most profound classical scholars that Great Britain has produced, and, at the same time, as one of the most quarrelsome, arrogant, and grasping of men. The circumstance which made the most noise in his career was his controversy with the Hon. Charles Boyle regarding the authenticity of the Epistles of Phalaris and the Fables of ?sop. In this dispute he had to contend with Drs. Atterbury, French, King, and Smallridge, who made the reply to him in their "Examination of Bentley's Dissertation on the Epistles," in the name of Boyle. Swift also attacked him in "The Battle of the Books." The controversy made an immense noise at the time, and Bentley completely proved his assertion, that both the Epistles of Phalaris and the Fables of ?sop, in their present form, are spurious. The services of Bentley in publishing corrected editions of various classical works are of no ordinary kind. Amongst the authors who have received the benefit of his critical touches are Aristophanes, Cicero, Menander, Philemon, Horace, Nicander, Ph?drus, and Homer. In his editions of Horace and Homer, however, he laid himself open to severe criticism by his rash and arbitrary emendations of the text, and still more so by his edition of Milton's "Paradise Lost," from the same cause. In this case he showed that he was as deficient in the Italian and romantic learning, which Milton had made himself master of, as he was great in his own classical field. Bentley displayed himself as a theologian of great distinction by his refutation of Collins's "Discourse of Freethinking," and his lectures at Oxford in defence of the Christian religion.These motions were defeated, and Lord North, on the 21st of June, moved for the introduction of a Bill to double the militia and raise volunteer corps. The proposal to double the militia was rejected, that to raise volunteer corps accepted. To man the Navy a Bill was brought in to suspend for six months all exemptions from impressment into the Royal Navy. The measure was passed through two stages before rising, and carried the next morning, and sent up to the Lords. There it met with strong opposition, and did not receive the Royal Assent till the last day of the Session. This was the 3rd of July, and was followed, on the 9th, by a Royal Proclamation ordering all horses and provisions, in case of invasion, to be driven into the interior. The batteries of Plymouth were manned, and a boom was drawn across the harbour at Portsmouth. A large camp of militia was established at Cox Heath, in front of Maidstone, and, in truth, this demonstration of a patriotic spirit was very popular.

THREE:The year 1844 brought little progress to the Free Traders in Parliament. The members of the House of Commons had been elected in 1841, in the teeth of the Free Trade cry raised by the Whigs, and before the League had made its power felt in the elections. Sir Robert Peel declared that the Government "did not contemplate and had never contemplated any change in the existing Corn Laws." At recent public meetings influential members of the Tory party had openly threatened the Minister with expulsion unless he maintained those laws for their benefita fact which drew from Mr. Villiers the remark that he regretted that the Prime Minister had not "the spirit to turn round upon these people, and show them their utter helplessness without him, their utter inability to administer, without him, the government upon their own system." Indeed, it began now to be assumed by all persons favourable to Free Trade that the Minister's opinions were really far in advance of his own party, and that he needed only a favourable opportunity to declare himself openly at variance with their views. The great meetings at Covent Garden Theatre, immediately before the opening of Parliament, kept the subject before the public.Next came the enactments regarding fasting. By 5 Elizabeth every person who ate flesh on a fish day was liable to a penalty of three pounds; and, in case of non-payment, to three months' imprisonment. It was added that this eating of fish was not from any superstitious notion, but to encourage the fisheries; but by the 2 and 3 Edward VI. the power of inflicting these fish and flesh penalties was invested in the two Archbishops, as though the offence of eating flesh on fish days was an ecclesiastical offence. Lord Stanhope showed that the powers and penalties of excommunication were still in full force; that whoever was excommunicated had no legal power of recovering any debt, or payment for anything that he might sell; that excommunication and its penalties were made valid by the 5 Elizabeth and the 29 Charles II.; that by the 30 Charles II. every peer, or member of the House of Peers, peer of Scotland, or Ireland, or member of the House of Commons, who should go to Court without having made the declaration against transubstantiation, and the invocation of saints therein contained, should be disabled from holding any office, civil or military, from making a proxy in the House of Lords, or from sueing or using any action in law or equity; from being guardian, trustee, or administrator of any will; and should be deemed "a Popish recusant convict." His Lordship observed that probably the whole Protestant bench of bishops were at that moment in this predicament, and that he had a right to clear the House of them, and proceed with his Bill in their absence. Thus, instead of sixteen ounces to the pound, they received only fourteen ounces; and the same rule applied to the measurement of liquidsbeer and grogserved out to them. Things had come to such a pass from these causes, and the neglect of their complaint was so persevering, that the whole fleet determined on a mutiny.
